REPORT – TRANSPARENCY AND EQUAL PAY

In compliance with current legislation, and with a commitment to promoting inclusive and diverse practices, Fersol is publishing the Salary Transparency and Compensation Criteria Report.

In this regard, in accordance with the determination established by MTE Ordinance No. 3,714 of 2023 and Federal Decree No. 11,795 of 2023, which regulated the obligations arising from the Equal Pay Law (Law No. 14,611 of 2023), all companies with more than 100 employees must publish semi-annually the report made available by the Ministry of Labor and Employment (“MTE”), containing the averages and medians of annual remunerations, the first based on data from eSocial and supplementary information provided by the Emprega Brasil Portal.

It is important to note that the report published by the Ministry of Labor does not consider the different job levels or factors related to career progression.

It uses simple averages and medians of the entire employee population, grouped solely by CBO codes, and does not consider the various variables related to salary policies.

The data in this report is anonymized in accordance with the General Data Protection Law – LGPD 13.709/18.

The report presented by the Ministry of Labor and Employment, therefore, does not reflect the rules established by Law No. 14,611/2023, when comparing women and men who do not perform the same function or who do not perform work of equal value, disregarding the requirements of equal pay under Article 461 of the CLT (Consolidation of Labor Laws), which provides for equal pay for all work of equal value performed by workers who perform the same functions, for the same employer, in the same establishment.
